## Content

**Intro:** Not all GST paid on purchases can be claimed as input tax credit. Section 17(5) of the CGST Act blocks credit for certain categories even when the expense relates to business. This table gives manufacturers and finance teams a quick reference.

**Sections:**

#### How to use this reference

**Body:** Search for the kind of expense, such as vehicles, food, memberships or construction, and read the exception column. The exceptions matter because the rule is often narrower than people think. For example, motor vehicle credit is blocked in general but allowed when the vehicle is used to carry out a taxable supply of vehicles or transport. Use the tip column to decide how to flag expense accounts and fixed asset classes in your ERP. Export to Excel to attach to your AP policy.

#### Why the blocked list exists

**Body:** GST allows credit on inputs used in the course or furtherance of business. The law then removes certain items where personal consumption is likely or where the cost relates to immovable property. Credit is also available only if the conditions of Section 16 are met, which means a valid tax invoice, receipt of goods or services, the tax being paid by the supplier, and the return being filed. Blocked credit should be reported as ineligible in GSTR-3B rather than claimed and reversed later.

**Bullets:**

- Section 17(5) lists blocked categories
- Section 16 sets conditions for eligible credit
- Rule 42 and 43 apportion credit on exempt supplies
- Ineligible credit is reported separately in GSTR-3B

#### Common mistakes

**Body:** Companies often claim credit on staff food, employee gifts and company cars because the vendor invoice shows GST. Others miss that goods destroyed or written off require a reversal. Capital projects are a frequent trouble spot because plant and machinery is eligible but the building around it is not, and the invoice may bundle both. Build review rules into vendor invoice approval so these items are tagged before posting.

#### ERP notes

**Body:** In SAP, Oracle, Dynamics, Tally and Busy, the cleanest approach is a separate non-creditable tax code or tax rule for blocked categories, assigned by GL account. For write-offs and scrap, tie the reversal to the inventory transaction so the finance team does not depend on memory. Report the blocked credit monthly so it can be compared with the figure reported as ineligible in the return.

**Cta:** Netray can help build a read-only report of creditable versus non-creditable GST by account, so the figure in your return can be tied back to the ledger.

**Faq:**

#### Is ITC on motor vehicles allowed?

**Answer:** In general no, if the vehicle is designed to carry 13 persons or fewer including the driver. It is allowed when the vehicle is used for further supply of such vehicles, passenger transport, or driver training. Vehicles for goods transport are outside this block.

#### Can I claim ITC on staff canteen food?

**Answer:** Generally no, because food and beverages are blocked. An exception applies where providing the food is mandatory under law, such as a factory canteen requirement, and the credit position should be reviewed for that case. Many companies claim it only with proper legal support.

#### Is ITC allowed on plant and machinery?

**Answer:** Yes, plant and machinery is not blocked even when it is installed on land. The block relates to buildings and civil structures. Separate the costs in the purchase order and invoice so the creditable portion is clear.

#### How is blocked credit reported in the return?

**Answer:** Ineligible credit is shown in the ITC section of GSTR-3B under the relevant ineligible lines, such as ITC under Section 17(5). If you claimed it earlier by mistake, you must reverse it with interest in line with the rules.
