## Tool

**Kind:** calculator

**Inputs:**

#### SVHC mass per article

**Key:** svhc_g

**Type:** number

**Default:** 0.4

**Min:** 0

**Step:** 0.05

**Unit:** g

**Help:** Mass of the candidate list substance in one article, such as one cable or one gasket.

#### Article mass

**Key:** article_g

**Type:** number

**Default:** 250

**Min:** 0.01

**Step:** 5

**Unit:** g

**Help:** Mass of the article itself. For a complex product, use each article incorporated in it, not the finished product.

#### Units placed on the EU market per year

**Key:** units

**Type:** number

**Default:** 20000

**Min:** 0

**Step:** 500

**Unit:** units

#### Concentration threshold

**Key:** threshold

**Type:** number

**Default:** 0.1

**Min:** 0.001

**Step:** 0.01

**Unit:** % w/w

**Help:** 0.1% by weight for most candidate list substances.

**Outputs:**

#### SVHC concentration in the article

**Key:** conc

**Expr:** svhc_g / article_g * 100

**Format:** decimal

**Primary:** true

**Description:** Weight percent of the SVHC in the article.

#### Above threshold (1 = yes)

**Key:** over

**Expr:** gt(conc, threshold)

**Format:** integer

**Description:** If 1, the supplier duty to inform recipients under Article 33 applies.

#### Annual SVHC quantity in articles

**Key:** tonnes

**Expr:** svhc_g * units / 1000000

**Format:** decimal

**Description:** Tonnes of the substance placed on the market in articles per year.

#### Above 1 tonne per year (1 = yes)

**Key:** tonne_flag

**Expr:** gt(tonnes, 1)

**Format:** integer

#### Notification screen (1 = both tests met)

**Key:** notify

**Expr:** and(over, tonne_flag)

**Format:** integer

**Primary:** true

**Description:** Both the concentration and tonnage conditions of Article 7(2) are met, subject to exclusions such as exposure.

**Chart:**

#### Annual SVHC tonnage vs units sold

**Type:** line

**X:** units

**From:** 0

**To:** 4000000

**Steps:** 40

**Series:**

- tonnes

**Disclaimer:** Screening aid only. Article 7(2) notification has exclusions, for example where exposure can be excluded, and the SCIP database duty under the Waste Framework Directive is separate. Confirm with the current candidate list and your legal advisor.

## Content

**Intro:** Under REACH, a substance on the Candidate List above 0.1% by weight in an article triggers duties to inform customers, and above one tonne a year it can trigger notification to ECHA. This tool checks both tests with the numbers you already have.

**Sections:**

#### How to use it

**Body:** Enter the SVHC mass in one article and the mass of that article. Then add the number of units you place on the EU market per year. The tool returns concentration, the Article 33 flag, the annual tonnage and a combined notification screen. Run it per article in a complex product, because the Court of Justice held in the O5A ruling that the 0.1% threshold applies to each article incorporated, not to the final product as a whole.

**Bullets:**

- One run per article, not per finished product
- Update the threshold only if the substance has a specific limit
- Check the Candidate List every January and July

#### The rules it screens

**Body:** Article 33 requires a supplier of an article containing a Candidate List substance above 0.1% w/w to give recipients enough information for safe use, and to answer consumer requests within 45 days. Article 7(2) requires notification when the substance is present in articles above 0.1% w/w and the producer or importer places more than one tonne per year on the market. Since 5 January 2021, suppliers must also submit article data to the SCIP database for such articles. The calculator reproduces the arithmetic, not the legal exclusions.

**Bullets:**

- Concentration = SVHC mass / article mass x 100
- Tonnes = SVHC grams x units / 1,000,000
- Notification screen = both tests exceeded

#### Reading the result

**Body:** With the defaults, 0.4 g in a 250 g article is 0.16% and above the threshold. At 20,000 units the SVHC quantity is 0.4 g times 20,000, or 8,000 g, which is 0.008 tonnes and far below one tonne, so notification is not triggered but Article 33 and SCIP still are. Use the chart to find the volume at which tonnage crosses one tonne. Many teams fix the first duty and forget the second.

#### Common mistakes

**Body:** Using the mass of the finished product as the denominator is the classic error. Another is summing a substance across several suppliers without noting that the one tonne trigger is per producer or importer, not per product line. Teams also record the declaration once and never revisit it when a new substance joins the Candidate List. Store the declaration date and list version against the item in your ERP so reviews can be targeted.

**Cta:** Netray can help you link supplier declarations to item and BOM data in your ERP so a Candidate List update shows which items need a new statement.

**Faq:**

#### Is the 0.1% measured on the finished product?

**Answer:** No. Following the 2015 Court of Justice O5A ruling, the 0.1% w/w threshold applies to each article that is incorporated as a component in a complex product, so you must evaluate each article separately.

#### What is the one tonne trigger?

**Answer:** It is the quantity per producer or importer per year of the substance contained in all articles of that kind placed on the EU market. Above that and above 0.1% w/w, notification to ECHA may be required unless exposure can be excluded.

#### Does Article 33 have a tonnage limit?

**Answer:** No. The duty to inform recipients applies whenever the Candidate List substance is above 0.1% w/w in the article, regardless of quantity. Consumers can ask for the information and must get an answer within 45 days.

#### How often does the Candidate List change?

**Answer:** ECHA normally updates it twice a year, around January and June or July. Each update can put new substances into scope, so a periodic re-screen of your BOM against the current list is needed.
