**Notes:** Under REACH the 0.1% w/w threshold applies to each article as supplied, and an article that is part of a complex object is assessed on its own. Always check the current Candidate List on the ECHA site because it is updated at least twice a year. This is a screening aid, not legal advice.

## Content

**Intro:** REACH Article 33 requires suppliers of articles containing a Candidate List substance above 0.1% weight by weight to pass safe-use information down the chain. This worksheet helps you record the substances you find, compute the concentration against the article mass and see at a glance which entries cross the line.

**Sections:**

#### How to use the worksheet

**Body:** Enter one row for each substance in each article. Put in the substance mass and the mass of the article as it is supplied, and the sheet calculates the weight-by-weight percentage and flags anything above 0.1%. Replace the example rows with your own data and note where each number came from, because an estimate carries less weight than a test report. Export to Excel to attach to your compliance records or share with the customer who asked.

#### The 0.1% calculation

**Body:** Concentration is the mass of the substance divided by the mass of the article, times 100. The key point from European case law is that the threshold applies to each article incorporated in a complex product, not the finished product as a whole. So a 0.5 g solder joint with lead is judged against the mass of that article, and you must work out what counts as an article in your own bill of materials. Where this is unclear, treat the lowest-level article that was produced as a unit as the denominator and seek advice.

**Bullets:**

- Use the article mass as supplied, not the finished product mass
- Record the CAS number so lookups against the Candidate List are exact
- Record the source of the figure and its date
- Re-screen when the Candidate List is updated

#### Reading the result

**Body:** A zero in the over-threshold column means no Article 33 duty for that entry on the data you have, not that the substance is absent. A one means you need to provide the recipient with enough information to allow safe use, as a minimum the name of the substance. Consumers can also ask you for this information, and you must reply within 45 days. Track those requests, since they have a statutory time limit.

#### Common mistakes

**Body:** Using finished product mass as the denominator hides real exceedances. Screening against an old copy of the Candidate List misses newly added substances. Treating a supplier's blanket statement as proof for every part number is another frequent gap. Finally, remember that Article 33 communication and SCIP database notification are separate obligations for articles placed on the EU market, so check both.

**Cta:** If you maintain substance data per part in your ERP, we can help set up a recurring check against each new Candidate List update.

**Faq:**

#### Does the 0.1% threshold apply to the whole product?

**Answer:** No. The Court of Justice of the EU ruled that it applies to each article that is incorporated into a complex product. That means you need to identify articles at the component level and compare the substance mass with that component mass.

#### How often does the Candidate List change?

**Answer:** ECHA updates it at least twice a year, usually in January and June, though dates vary. Set a calendar reminder to re-screen your bill of materials after each update and record the version you checked against.

#### What do I have to tell my customer?

**Answer:** At a minimum, the name of the Candidate List substance, plus any other information available to you that allows safe use of the article. Business customers should receive it automatically, while consumers can request it and must be answered within 45 days.

#### Is an estimate acceptable?

**Answer:** It can be a starting point for screening, but it is weak evidence. Where a figure is near 0.1%, ask the supplier for a declaration or commission a test. Record the source column so reviewers can see how firm each number is.
