Under Article 33 of Regulation (EC) No 1907/2006, a supplier of an article containing a substance of very high concern on the Candidate List above 0.1 percent weight by weight must provide sufficient information to allow safe use of the article, including at least the name of the substance. Please complete the table below for the parts listed, using Candidate List as published on ECHA website at date of request.

A starting point, not legal advice. The Candidate List is updated regularly, so re-check against the current version. Articles placed on the EU market may also have SCIP database notification duties under the Waste Framework Directive. Confirm obligations with your compliance specialist.

How to use the template

Enter your details, the supplier, the part family and a reply date, then export to PDF or Word and send. The response table asks for substance name, identifiers, location in the part, concentration range and safe use information. Send one request per supplier covering all parts rather than one per part. Store replies by part number so product compliance can answer customer questions later.

What the rule says

Article 33 of REACH obliges suppliers of articles containing a Candidate List SVHC above 0.1 percent w/w to pass on information that allows safe use, including the substance name. Consumers can request this and must receive a reply within 45 days. The threshold applies to each article, including components of complex products, according to the Court of Justice ruling and ECHA guidance. The Candidate List grows twice a year or so, so past answers go out of date.

Common mistakes

Frequent problems are supplier answers that cite a general REACH compliance statement without addressing SVHC, applying the 0.1 percent to the whole finished product instead of each article, and keeping no record of which list version was checked. Plan a re-request after each Candidate List update for high-risk categories such as plastics, coatings, solders, cables and rubber.

  • Always state the Candidate List version checked
  • Ask for substance name and location, not only yes or no
  • Track unanswered requests with an owner and date
  • Link replies to ERP item and supplier records

Frequently Asked Questions

What is an SVHC?

A substance of very high concern is a chemical identified under REACH because of hazards such as carcinogenicity, toxicity to reproduction or persistence, and placed on the Candidate List. Listing triggers information duties for articles.

What does the 0.1 percent threshold apply to?

It applies to the weight of the substance in each article, including each component article within a complex product. It is not calculated across the finished assembly as a whole.

Do non-EU suppliers have to answer?

Importers and EU suppliers carry the legal duty, so you may need to push the request upstream. Non-EU suppliers often respond because customers require it contractually.

How often should I repeat the request?

The Candidate List is updated periodically, so many companies repeat requests at least yearly and after significant additions. Use a list of high-risk parts to prioritise.

If you want to track supplier replies against ERP items and flag expired answers, we can design that with you. The template is free and independent.
