How to use the template
Enter your company, the customer, the article number and revision, and the Candidate List version you checked against. Choose whether any SVHC is above 0.1% weight by weight. If yes, name the substance, CAS or EC number and where it sits in the article, and add safe use information. Export to Word or PDF, then have an authorised person sign. Keep one declaration per article revision.
The rule behind it
Under REACH Article 33, a supplier of an article containing a Candidate List substance above 0.1% w/w must give recipients enough information to allow safe use, including at least the substance name. Consumers can ask and must be answered within 45 days. Since 2021, producers and importers of such articles in the EU must also notify the ECHA SCIP database under the Waste Framework Directive. The Court of Justice ruled in 2015 that the 0.1% applies to each article within a complex product.
Common mistakes
Many declarations cite an old Candidate List or a generic phrase of compliance without naming a version. Others apply 0.1% to the whole assembly instead of each article. The Candidate List is updated twice a year, so a declaration can be outdated within months.
- Not stating the Candidate List version
- Missing sub-supplier data on purchased components
- Confusing REACH SVHC with RoHS limits
- Skipping safe use information when an SVHC is present
Frequently Asked Questions
What is an SVHC?
A substance of very high concern is a chemical identified under REACH for properties such as carcinogenicity or persistence. Once placed on the Candidate List, suppliers of articles that contain it above 0.1% w/w have information duties.
How often should I update the declaration?
ECHA updates the Candidate List usually twice a year. Re-check your parts against each update and reissue declarations where the answer changes. Many customers request an annual refresh as a minimum.
Is a REACH declaration the same as a RoHS declaration?
No. RoHS restricts specific substances in electrical equipment, while REACH Article 33 is about information on Candidate List substances in articles. A product can need both, and they use different lists and thresholds.
Who must sign the declaration?
Use a person with authority to make binding statements for the company, often a compliance manager or quality director. Customers may specify their own format, so check whether your template meets their needs before sending.
If you answer many such requests each month, we can help automate the first draft from your ERP part data and stored supplier declarations, with human sign-off.
