How to use the calculator

Enter the last drawn monthly basic plus dearness allowance, the completed years of service and any extra months. Leave the days and divisor at 15 and 26 unless your policy differs. The tool returns service counted, gratuity per year, the uncapped amount and the final payable amount after the ceiling. Use it for retirement, resignation, death and termination cases, and for year-end provisioning by running it for each employee on a sample. The chart shows how the amount grows with tenure.

The formula

For employees covered by the Payment of Gratuity Act and paid monthly, gratuity equals last drawn wages multiplied by 15, divided by 26, multiplied by completed years of service. Service above six months in the last year counts as a full year. Wages mean basic plus dearness allowance. Seasonal establishments use a different day count, and piece-rated workers use average wages of the last three months. The statutory ceiling is Rs 20 lakh, though employers may pay beyond it under their own policy.

  • Divisor 26 reflects working days in a month
  • Only basic plus DA counts as wages
  • Fraction above six months rounds up

Worked example

An operator has 12 years and 8 months of service and a last drawn basic plus DA of Rs 32,000. The extra 8 months exceed six, so service counted is 13 years. Gratuity per year is 32,000 times 15 divided by 26, about Rs 18,462. Multiply by 13 to get roughly Rs 2.40 lakh, which is under the cap and is paid in full.

Common mistakes

Payroll teams often include HRA or special allowances in wages, which overstates the liability. Another error is using 30 as the divisor for monthly-rated staff when the Act uses 26. Plants also forget to update provisions after wage revisions. Link the calculation to the employee master in your ERP or HR system so basic plus DA and joining dates flow in automatically, and have an actuary value the liability if you fund through a trust.

Frequently Asked Questions

Who is eligible for gratuity?

Employees of covered establishments generally become eligible after five years of continuous service, with exceptions on death or disablement. Recent labour code changes have introduced shorter qualifying periods for fixed-term staff, so check the rules in force for your category before deciding.

Why is the divisor 26 and not 30?

The Act treats a month as 26 working days for monthly-rated employees, because Sundays are paid weekly offs. Using 30 reduces the amount. Some employers deliberately pay on 30 as a more generous policy, which is allowed.

Is gratuity taxable?

Gratuity received by employees covered by the Act is exempt up to the lower of the formula amount, the notified ceiling and the actual amount received. Amounts beyond the exemption are taxed as salary. Check the current ceiling with your tax advisor before filing.

Does overtime count as wages?

No. Wages for the formula are basic plus dearness allowance, and exclude overtime, bonus, commission, HRA and similar payments. Including them would overstate the liability and could create a precedent if challenged.

If gratuity, leave and statutory provisions are still computed offline, we can help build the calculation inside your ERP payroll or finance module.
