Response to FDA Form 483

2026-10-30

FDA Office of Medical Device and Radiological Health Operations, Division 3

Re: Acme Medical Devices Inc., FEI 3012345678 Inspection concluded 2026-10-16

Introduction

Acme Medical Devices Inc. thanks the investigator for the inspection. This letter responds to the Form FDA 483 observations. We take each observation seriously and describe below the corrections made, root cause, and actions planned.

Observation 1

Observation: Procedures for corrective and preventive action have not been adequately established, in that CAPA records did not show effectiveness verification.

Correction: Quality opened a retrospective review of 24 CAPAs closed in the last 18 months and added effectiveness checks to the CAPA form.

Root cause: The CAPA procedure did not require documented effectiveness criteria at plan approval, and closure reviews were not audited.

Corrective and preventive action: Revise SOP-QA-012, retrain CAPA owners, and add effectiveness verification as a gate in the electronic CAPA workflow.

Target completion: 2027-01-31

Starting point, not legal advice. Respond within 15 business days if you want FDA to consider the response before deciding on a warning letter. Have counsel and senior management review. Attach evidence, and do not promise what you cannot deliver by the stated date.

Need audit evidence pulled from ERP fast?

Optional review of building retrieval for inspection and response evidence.

Optional. The tool and every export work without this. No spam.

How to use the template

Complete one block per observation. State the observation as written, then the correction already made, the root cause, the corrective and preventive action, and a realistic due date. Add attachments for evidence such as revised procedures and training records. Export to Word, route it through quality, regulatory and senior leadership, and send within 15 business days of issuance.

What a good response contains

FDA reviewers look for scope: have you checked whether the problem exists elsewhere, not only in the example cited? They want a root cause, evidence of completed actions, and clear dates with owners. Systemic responses are stronger than isolated fixes. Say what you have already done and show documents, because promises without evidence carry less weight.

  • Address every observation separately
  • Show scope and extent review
  • Give dates and named owners
  • Attach objective evidence
  • Provide periodic status updates

Common mistakes

Responses that argue with the investigator, minimise the finding or blame an individual rarely help. Overpromising is just as damaging: a missed commitment date is later cited. Check that the action actually addresses the root cause, and avoid inconsistency with documents the inspector already saw during the inspection.

Frequently Asked Questions

How long do I have to respond to a 483?

FDA asks for a response within 15 business days. Responses received in that window are generally considered before a warning letter decision is made.

Is a 483 the same as a warning letter?

No. A 483 lists observations at the close of an inspection. A warning letter is a separate, formal agency notice of violations that may follow if issues are not addressed.

Should counsel review it?

Yes, for serious observations. The letter becomes a record and a commitment, so regulatory counsel and senior management should review before it goes out.

Can I include data and attachments?

Yes. Provide objective evidence such as revised procedures, training records, and investigation reports, and mark any confidential commercial information as such.

If you need evidence assembled quickly from ERP and quality records for a response, Netray can help set up retrieval. Ask for a short review.
