This is a starting point, not legal advice. Reporting timelines and criteria depend on the market, for example FDA medical device reporting under 21 CFR Part 803 and EU MDR vigilance rules. Follow your own complaint procedure and confirm decisions with regulatory affairs.

One view of complaints, returns and lots

Optional: a short review of linking complaint records to lot history and returns in your ERP.

Optional. The tool and every export work without this. No spam.

How to use this form

Complete the intake fields the same day you receive the complaint, even if you have limited information. Enter the device, lot, UDI and a factual description in the customer's words. Decide on patient involvement and reportability early, because reporting clocks start from awareness. Then export the form, run the investigation, record findings and close with a decision on corrective action. Reopen the record if new information arrives.

  • Log every complaint, including those that seem trivial
  • Record the date you became aware of the event
  • Request the device back whenever possible
  • Reassess reportability when new facts arrive

What regulators expect

ISO 13485 clause 8.2.2 requires documented procedures for timely complaint handling, including evaluating whether an investigation is needed, determining if the complaint must be reported to authorities, and recording the decision. Clause 8.2.3 covers reporting to regulatory authorities. In the United States, medical device reporting rules in 21 CFR Part 803 define when deaths, serious injuries and malfunctions are reportable and the time limits. The EU MDR has its own serious incident reporting timelines. Know the clocks for each market you serve.

Investigating the complaint

A good investigation reviews the device history record for the lot, evaluates returned product, searches for similar complaints, checks the risk management file for the failure mode, and reaches a root cause or states why one could not be found. If the issue was not anticipated in the risk file, update it. Link the complaint to a CAPA when it shows a systemic problem, and track complaint rates by product and failure mode to see trends.

Common mistakes

Frequent weaknesses are treating a complaint as service request, closing without trying to retrieve the device, deciding not reportable without a written rationale, and starting the clock from the investigation date instead of the awareness date. Complaints received by sales or distributors also get lost; train every channel to forward them quickly.

Frequently Asked Questions

What counts as a complaint for a medical device?

Any written, electronic or oral communication that alleges deficiencies related to identity, quality, durability, reliability, safety, effectiveness or performance of a device after it is released for distribution.

Who decides if a complaint is reportable?

Your procedure assigns the decision, usually to regulatory affairs or a designated complaint unit with quality input. The decision and its reasoning must be recorded, whether the answer is yes or no.

How long do I have to report?

It depends on the event and the market. FDA reporting by manufacturers is generally within 30 calendar days of awareness, with shorter limits for some events, and the EU sets shorter periods for serious incidents. Confirm current rules.

Do all complaints need an investigation?

Not always, but the decision not to investigate must be documented with a reason. Any complaint involving death, serious injury or a possible malfunction that could cause serious injury should be investigated.

If complaints, returns and service cases are spread across CRM and ERP, Netray can help connect them into one searchable view on your own infrastructure, with people making the reportability decision.
