South Africa B-BBEE Sworn Affidavit Template

Small South African suppliers are often asked by large customers for a B-BBEE sworn affidavit instead of a full verification certificate. This template drafts the wording from your own figures so you can review it and sign before a Commissioner of Oaths.

Starting point, not legal advice. Thresholds, ownership rules and prescribed wording are set by the B-BBEE Codes and the Department of Trade, Industry and Competition; confirm the current format with your verification agency or the Companies and Intellectual Property Commission guidance before signing before a Commissioner of Oaths.

Track supplier certificates in your ERP

Optional: we can help set up certificate expiry alerts and a supplier scorecard.

Optional. The tool and every export work without this. No spam.

How to use the template

Enter the deponent details, entity registration number, the financial year end, turnover and the ownership percentages from your share register. Review the numbered statements, export to Word or PDF and print it. The affidavit has no legal effect until it is signed in front of a Commissioner of Oaths, who adds their stamp and details. Keep a copy of your financial statements and share register as supporting evidence in case a customer asks.

  • Use the turnover figure from your financial statements, not an estimate
  • Ownership percentages come from the share register, not from management control
  • Sign only in the presence of the Commissioner of Oaths
  • Renew every financial year

Why an affidavit is used

Under the B-BBEE Codes of Good Practice, exempted micro enterprises and qualifying small enterprises can self declare their status with a sworn affidavit, which avoids the cost of a full verification. The category depends on annual turnover bands set in the Codes, and EMEs with high black ownership may qualify for a higher level automatically. Check the current thresholds, as they can be revised.

Worked example

A QSE with turnover of R 8.4 million and 55 percent black ownership drafts its affidavit with those figures and states the level it qualifies for under the Codes. The customer's supplier onboarding team attaches the signed affidavit to the supplier record in their ERP and uses the level in its preferential procurement scoring.

Common mistakes

Common problems are outdated turnover, using last year's affidavit, claiming a level that does not match the ownership figures, and presenting an unsigned or unstamped copy. Customers may also reject affidavits whose wording differs from their required format, so ask for it before you submit.

Frequently Asked Questions

Is this an official government form?

No. It is a draft built from the typical structure of EME and QSE affidavits. Always confirm the current official wording and thresholds before swearing it.

Does it need to be notarised?

It must be sworn or affirmed before a Commissioner of Oaths. Notarisation is a different step and is not usually required for this purpose, but ask your customer.

How often must it be renewed?

Typically once per financial year, based on the latest annual turnover. Many customers also set a validity period of twelve months from the date signed.

Can I use it for a larger company?

No. Larger enterprises generally need a full verification from an accredited agency. This template is intended for enterprises that qualify as EME or QSE.

If you manage supplier B-BBEE certificates inside an ERP, Netray can help design expiry tracking and scorecard reporting on top of it.
